Rules of Procedure

Councillor Signoretti moved to alter the order of the agenda to deal with Manager's Reports at this time.

    THAT the City of Greater Sudbury appoints Councillor Signoretti as Chair and Councillor Cormier as Vice-Chair of the Hearing Committee for the term ending December 31, 2024 or until their successors are appointed, as outlined in the report entitled “Appointment of Chair and Vice-Chair – Hearing Committee”, from the General Manager of Corporate Services, presented at the Hearing Committee meeting on February 14, 2023.

The Hearing Committee was adjourned and the Public Hearing was opened to deal with the hearing.

Justin Gaudette, of Valley Growers, the petitioner was present.

Paul Javor, Drainage Engineer, outlined the report and Neal Morris, of K. Smart, provided an electronic presentation.

Staff responded to questions from the Committee members.

The petitioner provided comments and responded to questions from the Committee members.

The Chair asked whether there was anyone who wished to speak in favour or against this matter and the following concerned residents provided comments to the Committee members:

Edward McLaren, Daniel Yasko, Robert Lalonde, Marcel Rainville, Allan Guse, Marianne Benard-Tessier and Scott Halladay spoke in favour or against this matter.

At 7:30 p.m. the Committee recessed.

At 7:45 p.m. the Committee reconvened.

The Public Hearing concerning this matter was closed and the Hearing Committee resumed in order to discuss and vote on the matter.

The following alternate resolution was presented:

    THAT the City of Greater Sudbury refers the Engineer’s Report, dated November 25, 2022, back to the Engineer to revise the report to remove intervals 3, 4 and 5 from the proposed drain construction work, and remove allowances from owners affected by the proposed drain construction for intervals 3, 4 and 5;

    AND THAT the incurred Engineering costs for intervals 3, 4 and 5 be assessed to the landowners along the deleted work;

    AND THAT the Engineer’s Report, dated November 25, 2022, Section 4 – Authority for Report, be amended to remove role number 023-01300 as a petitioner.
