This report provides a recommendation regarding an application to rezone the subject lands to “C2”, General Commercial in order to permit an automotive service station with accessory convenience store and car wash along with two general commercial buildings containing a mix of restaurant and retail store land uses. The development proposal also includes three drive-through service facilities associated with the proposed restaurant and car wash land uses.

For the purpose of convenience and for expediting meetings, matters of business of repetitive or routine nature are included in the Consent Agenda, and all such matters of business contained in the Consent Agenda are voted on collectively.

A particular matter of business may be singled out from the Consent Agenda for debate or for a separate vote upon the request of any Councillor. In the case of a separate vote, the excluded matter of business is severed from the Consent Agenda, and only the remaining matters of business contained in the Consent Agenda are voted on collectively.

This report provides a recommendation regarding an application for an extension to the draft plan of subdivision approval for the subject lands (File #780-6/11003) for a period of three years until June 19, 2026.

This report provides a recommendation regarding a request to deem certain lots not to be part of a registered plan of subdivision, 3951 Chief Lake Road, Sudbury.

As presented by Councillor Cormier:


WHEREAS the Planning Act regulates the land use planning system in Ontario, including matters related to the subdivision of land;


AND WHEREAS certain transfers of land are prohibited without consent of a municipality, including situations where a landowner retains interest in abutting lands (commonly known as ‘merging on title’);


AND WHEREAS Policy 7 of Section 7.3.1 of the City’s Official Plan requires either the dedication of land or payment-in-lieu of the parkland dedication as a condition of consent;


AND WHEREAS the City is in the process of developing a parkland dedication by-law to supplement the Official Plan Policies;


THEREFORE BE IT RESOLVED THAT staff be directed to include in the upcoming draft by-law language that would exempt the taking of parkland dedication in situations where lots have ‘merged on title’;


AND THAT the City’s delegated official be directed not to apply the parkland dedication requirement in those situations until such time that a parkland dedication by-law is passed.
