In the case of a separate vote, the excluded matter of business is severed from the Consent Agenda, and only the remaining matters of business contained in the Consent Agenda are voted on collectively.

This presentation will provide an update regarding staff’s activities in response to Council resolution CC2023-47, passed on February 21, 2023.

This report provides recommendations regarding a response to resolution number CC2023-24 which requested financial and operational implications of three options to maintain, renovate or consolidate the city’s Fire and Paramedic Stations.


This report was deferred from the June 27, 2023 City Council meeting.  Given the volume of the attachments, they have not been appended to the agenda.  The attachments can be viewed at: https://www.greatersudbury.ca/agendas  (City Council agenda of June 27, 2023).

This report provides information regarding the results of the community engagement for the Emergency Services Station Location Study.

A By-law of the City of Greater Sudbury to Amend By-law 2010-100Z being the Comprehensive Zoning By-law for the City of Greater Sudbury


Planning Committee Resolution #PL2023-90


This by-law rezones the subject property to "R3(87)", Medium Density Residential Special in order to permit the conversion of an existing rooming house with 40 beds to a multiple dwelling with 46 apartment units - Sudbury Apartment Rentals Limited & 2347179 Ontario Limited, 219 - 235 O’Neil Drive East, Garson.

WHEREAS Council, by Resolution CC2023-72 approved Planning Committee resolutions PL2023-64 to PL2023-69 and PL2023-71 to PL2023-72 from the meeting of April 24, 2023


AND WHEREAS resolution PL2023-67 with regard to the Draft Plan of Subdivision Application for 0 Bancroft Drive contained 39 conditions, 4 of which read as follows:


9. That the owner will be required to enter into a written agreement to satisfy all requirements,
financial and otherwise, of the City, concerning the provision of roads, walkways,
streetlighting, sanitary sewers, storm sewers, stormwater management facilities, watermains
and surface drainage.


11. That a sidewalk be constructed on one side of the north/south street with a connection across Bancroft Drive to the existing sidewalk network. 


18. The owner shall be required to have all stormwater management facilities constructed and
approved by the City prior to initial acceptance of roads and sewers or at such time as the
Director of Planning Services may direct. The owner shall provide lands for said facilities as
required by the City, which will include a block for the stormwater management pond and
related outlets, and a block for the drainage ditch beginning at the west boundary of the site
and continuing to the southerly boundary being a minimum of 18.29 meters (60 feet) wide
and centred on the ditch, to the satisfaction of the Director of Planning Services.


19. The owner shall provide a block comprising all the lands on the west side of the drainage
ditch noted in Condition #19, to the satisfaction of the Director of Planning Services. 


AND WHEREAS Council for the City of Greater Sudbury would like to revise the above-noted conditions that would require the owner to transfer lands to the City for a drainage ditch and construct a sidewalk and connection;


THEREFORE BE IT RESOLVED that Resolution CC2023-72 be reconsidered.

As presented by Councillors Leduc and Fortin:


WHEREAS Council, by Resolution CC2023-72 approved Planning Committee resolutions PL2023-64 to PL2023-69 and PL2023-71 to PL2023-72 from the meeting of April 24, 2023

“9. That the owner will be required to enter into a written agreement to satisfy all requirements, financial and otherwise, of the City, concerning the provision of roads, streetlighting, sanitary sewers, storm sewers, stormwater management facilities, watermains and surface drainage.”


2.    By deleting Condition #11 which would have required a sidewalk to be constructed on one side of the north/south street with a connection across Bancroft Drive to the existing sidewalk network.


3.    By revising Condition #18 to require an easement for the drainage ditch rather than providing a block for the drainage ditch to the City, and with a width of 9.14 metres (30 feet) rather than 18.29 meters (60 feet), such that the condition reads as follows:


“18. The owner shall be required to have all stormwater management facilities constructed and approved by the City prior to initial acceptance of roads and sewers or at such time as the Director of Planning Services may direct. The owner shall provide lands for said facilities as required by the City, which will include a block for the stormwater management pond and related outlets, and an easement for the drainage ditch beginning at the west boundary of the site and continuing to the southerly boundary being a minimum of 9.14 meters (30 feet) wide and centred on the ditch, to the satisfaction of the Director of Planning Services.”


4.    By deleting Condition #19 which would have required lands on the west side of the drainage ditch to be provided to the City.


 

As presented by Councillors Leduc and Fortin:


WHEREAS Council, by Resolution CC2023-52 approved Planning Committee resolutions PL2023-51 to PL2023-57 from the meeting of March 20th, 2023;


AND WHEREAS resolution PL2023-51 read as follows:


THAT the City of Greater Sudbury approves the application by the Community Church of the Way to amend Zoning By-law 2010-100Z by changing the zoning classification from “l(43)”, Institutional Special to “C1”, Local Commercial Special on lands described as PIN 73581-0275, Parcel 14649 SEC SES; Lots 75 and 76, Plan M129, Township of McKim; S/T LT154590, LT23487; Greater Sudbury, as outlined in the report entitled “1325 Bellevue Avenue, Sudbury”, from the General Manager, Growth and Infrastructure, presented at the Planning Committee meeting on March 20, 2023, subject to the following conditions:


1. That prior to the enactment of an amending zoning by-law: 
a. The owner shall have constructed a test maintenance hole to the satisfaction of the Director of Planning Services.


2. That the amending zoning by-law include the following site-specific provisions:
a. ‘Business office’, to a maximum net floor area of 150 metres squared per lot, be a permitted use; and,
b. The following uses be prohibited:
c. Group Home Type 1;
d. Private Home Daycare; and,
e. Day Care Centre


AND WHEREAS the decision to request the construction of a test maintenance hole was done in accordance with Section 21(1) of the Sewer Use By-law 2010-188 that requires the installation of a test maintenance hole:   “Every person being the owner or operator of commercial, institutional or industrial premises or multi-residential buildings with one or more connections to the sewage works shall install in each connection, a suitable monitoring manhole to allow observation, sampling and flow measurement of the sewage, uncontaminated water or storm water therein.”


AND WHEREAS Section 21(2) of that by-law indicates that (2) Despite Subsection 21(1), where on application of the owner or operator of a commercial, institutional or industrial premises or multi-residential building, the General Manager is satisfied that the installation of a monitoring manhole is not feasible or possible in the circumstances, the General Manager may authorize in writing the installation of a specified alternative device or facility instead of a monitoring manhole on such conditions as the General Manager may determine;


AND WHEREAS Council for the City of Greater Sudbury would like to remove the condition that the owner shall have constructed a test maintenance hole;


THEREFORE BE IT RESOLVED that Resolution CC2023-52 be reconsidered.

If granted by a 2/3 majority, the following motion would then be considered:


As presented by Councillors Leduc and Fortin:


WHEREAS the applicants have attempted to construct a test maintenance hole to the satisfaction of the Director of Planning Services as indicated in Resolution PL2023-51, but have experienced some challenges meeting that condition which will cause them significant financial distress should that condition remain;


AND WHEREAS City Council would like to have the condition that the owner shall have constructed a test maintenance hole to the satisfaction of the Director of Planning Services removed from the resolution;


THEREFORE BE IT RESOLVED that the City of Greater Sudbury direct that resolution PL2023-51 be amended to read as follows:

As presented by Mayor Lefebvre:


WHEREAS Fire Services play a crucial role in maintaining the safety of our community, protecting the public, property, and the environment for those who live, work, and play in our city. 


AND WHEREAS we depend on both full-time career firefighters and a large number of engaged volunteer firefighters to deliver the service levels approved by council and reflected within our Establish & Regulating By-law 


AND WHEREAS the recruitment and retention of volunteer firefighters has become increasingly difficult as described in the Canadian Association of Fire Chiefs 2022 Census Report that indicates there are 99,919 volunteer firefighters in Canada, which is about 21% lower that the last count in in 2016. 


AND WHEREAS Council has an interest in the overall state of our volunteer numbers and the activities being undertaken to recruit and retain active and engaged volunteers to deliver fire response within the municipality 


AND WHEREAS the province implemented on July 1, 2022 Ontario Regulation 343/22 Firefighter Certification made under the Fire Protection and Prevention Act 1997. Legislation that requires minimum certification levels for both career and volunteer firefighters that align with the service levels approved by municipal council, which includes fire suppression, rescue and emergency services. 


AND WHEREAS the Fire Service must meet compliance for suppression activities by July 1, 2026 and all technical disciplines by July 1, 2028 


THEREFORE, BE IT RESOLVED that the City of Greater Sudbury directs the General Manager of Community Safety to provide on a semi-annual basis (2nd and 4th quarters) to City Council the following for Information only update report that provides: 
• Current information on the status of our volunteer recruitment and retention activities, AND
 • Current information on the status of our progress in meeting the firefighter certification requirements found within with O. Reg 343/22 Fire Fighter Certification
