    THAT the City of Greater Sudbury City Council approves the recommended approach as outlined in the report entitled “Approach to a Comprehensive Aquatics Review” from the General Manager of Community Development, presented at the City Council meeting on February 21, 2023

    AND THAT the City of Greater Sudbury approves funding of $150,000 from the Tax Rate Stabilization Reserve for completion of the comprehensive aquatics review.

    WHEREAS Council endorsed the Therapeutic/Leisure Pool as a priority, a Feasibility Study has been prepared and architectural services to complete the schematic design phase have been commenced;

    AND WHEREAS the project has received seed capital funding in the amount of $656,000, community fund-raising efforts to date in the amount of $100,500, and a $1,000,000 commitment towards the project through a successful application to the Government of Canada’s Enabling Accessibility Fund (EAF) for midsized projects;

    AND WHEREAS the balance of capital funding required for the project in the amount of $4,199,500 was approved through the 2021 budget process;

    And WHEREAS Council directed staff to begin a comprehensive aquatics review that would rationalize and modernize aquatic recreation facilities in Greater Sudbury;

    AND WHEREAS the Therapeutic/Leisure Pool forms part of the review process for the Comprehensive Aquatics Strategy;

    THEREFORE BE IT RESOLVED THAT the City of Greater Sudbury directs staff to pause further work on the Therapeutic/Leisure Pool until the comprehensive aquatics review has been presented to Council.

The following resolution was presented:

    WHEREAS pursuant to By-Law 2018-145, being a by-law respecting the remuneration of members of Council of the City of Greater Sudbury, the base remuneration for the office of Mayor is currently in the amount of $179,429.67;

    AND WHEREAS Mayor Lefebvre, as part of his campaign, stated that if elected he would reduce the remuneration for the office of Mayor;

    THEREFORE BE IT RESOLVED that staff be directed to present a bylaw amendment to adjust the Mayor’s base remuneration for the 2023 calendar year to the amount of $143,000 to be effective on February 21, 2023.

    WHEREAS the City of Great Sudbury is committed to accident and illness prevention through the integration of health and safety considerations into all planning, operational and department activities;

    AND WHEREAS Section 32 of the Occupational Health and Safety Act (Duties of directors and officers of a corporation) states that “Every director and every officer of a corporation shall take all reasonable care to ensure that the corporation complies with: (a) this Act and the regulations; (b) orders and requirements of inspectors and Directors; and (c) orders of the Minister”.

    AND WHEREAS the City Council wishes to support staff in creating and maintaining a workplace culture dedicated to ensuring a healthy, safe, and prosperous community.

    THEREFORE BE IT RESOLVED that the City of Greater Sudbury directs the Chief Administrative Officer to prepare and present a quarterly report to City Council which will include:

    1. the City’s Occupational Health and Safety performance;
    2. a summary of reported critical injuries (as defined in the Occupational Health and Safety Act);
    3. a summary of orders issued by inspectors and the Minister, including how many have been abated and how many are outstanding;
    4. a summary with any data analysis and remedial action planned;
    5. an update on relevant initiatives that ensure that the corporation complies with the Act and regulations; and
    6. an update on other initiatives that are intended to mitigate Occupational Health and Safety risks in our workplaces.

Councillor Vagnini moved to defer this item to the next City Council meeting to allow additional documentation to be considered.

    WHEREAS bees and native pollinators are experiencing population decline worldwide due to habitat loss, pesticide use, climate change and other factors;

    AND WHEREAS pollinators are essential for healthy biodiversity, ecosystem and food sources;

    AND WHEREAS many municipalities across Canada are showing support for bees and other pollinators by protecting their natural habitat;

    AND WHEREAS supporting pollinators fosters environmental awareness and sustainability, and increases interactions and engagement among community stewards;

    AND WHEREAS the City of Greater Sudbury recognizes the climate crisis and supports the implementation of the Greater Sudbury Food Strategy, Biodiversity Plan, Community Energy and Emissions Plan and EarthCare Sudbury Action Plan and their efforts to protect and enhance our food system, ecosystem and overall sustainability and resilience;

    AND WHEREAS studies show that monoculture lawns are detrimental to the biodiversity of pollinators and that allowing spring flowers to bloom and changing a mowing regime can increase biodiversity of ground cover, which includes edible species and flowering plants for pollinators;

    THEREFORE BE IT RESOLVED that the City of Greater Sudbury directs staff, in support of No Mow May, to present a by-law at the March 21st, 2023 City Council meeting to amend Part 3, Section 5 and Part 4, Section 13 of By-law 2009-101 to Require the Clearing of Yards and Certain Vacant Lots, as amended, to read as follows:

    Part 3 - Yard Maintenance

    Grass

    5.  No owner shall fail to cut any grass, weeds or wild vegetation growing on his or her yard that exceeds 20 centimetres in height "from June 1st to December 1st".

    Part 4 – Vacant Land and Vacant Lots

    Grass

    13.  No owner shall fail to cut any grass, weeds or wild vegetation growing on his or her vacant lot that exceeds 20 centimetres in height “from June 1st to December 1st.”

    AND BE IT FURTHER RESOLVED that the City of Greater Sudbury directs staff to work with community partners to promote No Mow May.

    WHEREAS the City of Greater Sudbury is committed to supporting the revitalization and vibrancy of the community's historic downtown using a balance of public investment, private sector incentives and regulatory frameworks; and 

    WHEREAS current economic realities dictate that municipal investment in the downtown is ideally leveraged through public and private partnerships that are balanced between new construction and repurposing of existing infrastructure; and 

    WHEREAS while the City remains supportive of the Junction East Cultural Hub project's goals, the current municipal financial commitment limits Council’s ability to address other priorities that are also important to Greater Sudbury’s future; and 

    WHEREAS unprecedented capital cost pressures demand responsive, innovative approaches to municipal service delivery; 

    THEREFORE BE IT RESOLVED that, notwithstanding Council Resolutions CC2022-153 to CC2022-157, the City of Greater Sudbury directs staff to suspend work on the current configuration of the Junction East Cultural Hub project and continue to work with the project partners, the Greater Sudbury Public Library, the Sudbury Multicultural Folk Arts Association, and the Art Gallery of Sudbury to analyze the following alternate approaches that fulfill the project's original goals as follows: 

    1. a)  Reconfigure existing high-value infrastructure and community-owned buildings in downtown Sudbury to create effective shared spaces or partnerships that will result in sustainable, efficient operations over the long term; and 
    2. b)Redesign the Junction East Cultural Hub to reflect total project cost of approximately $65 million and continues to reflect the desired outcome of a project that will be an enduring source of community pride   

    AND THAT staff provide a report presenting this analysis and a recommendation by the end of Q2 2023.

    AND THAT Jhonel Morven and Martin Lajeunesse be appointed for a four (4) year term; and Joshua Lilley and Kati McCartney be appointed for a two (2) year term as Directors of Greater Sudbury Hydro Inc., all until their successors are appointed as outlined in the report entitled “Appointment of Citizens to GSU and GSHI”, from the General Manager of Corporate Services, presented at the City Council meeting on February 21, 2023.

Councillor Sizer submitted a petition to the City Clerk which will be forwarded to the General Manager, Growth and Infrastructure. The petition is regarding the closure of the sidewalk on the west side of Auger Avenue from Hawthorne Drive to Falconbridge Highway during winter months.
