    THAT the City of Greater Sudbury moves to Closed Session to deal with (2) Proposed or Pending Acquisition or Disposition of Land Matters, the first regarding Birch Lane, Garson and the second regarding Roy Avenue, Sudbury and Agincourt Avenue, Sudbury in accordance with the Municipal Act, 2001, par. 239(2)(c).

    CARRIED

    At 11:32 a.m., the Planning Committee moved into Closed Session.

At 11:59 a.m., the Planning Committee recessed.

At 1:00 p.m., the Planning Committee commenced the Open Session.

A roll call was conducted.

The Planning Committee was adjourned and the Public Hearing was opened to deal with the application:

Michael and Lynn Banks, the applicants were present.

Mauro Manzon, Senior Planner, outlined the report.

The Chair asked whether there was anyone who wished to speak in favour or against the application and hearing none:

The Public Hearing was closed and the Planning Committee resumed in order to discuss and vote on the application.

  • The following resolution was presented:

    THAT the City of Greater Sudbury approves the application by Michael & Johanne Banks to amend Zoning By-law 2010-100Z with respect to lands described as PIN 73508-1091, Parcel 1139 S.E.S., in Lot 9, Concession 2, Township of Capreol in order to extend the use of a garden suite in accordance with Section 39.1(4) of the Planning Act for a temporary period of three (3) years, as outlined in the report entitled “944 Radar Road, Hanmer” from the General Manager of Growth and Infrastructure, presented at the Planning Committee meeting on May 29, 2023.

    YEAS: (3)Councillor Lapierre, Councillor Fortin, and Councillor Cormier
    Absent (2)Bill Leduc, and Councillor Landry-Altmann
    CARRIED (3 to 0)

    As no public comment, written or oral, has been received, there was no effect on the Planning Committee's decision.

    Councillor Landry-Altman arrived at 1:09 p.m.

    THAT the City of Greater Sudbury approves the application by Albert & Carol Rigg to amend Zoning By-law 2010-100Z with respect to lands described as PIN 73470-0209, Parcel 23804 S.E.S., in Lot 2, Concession 3, Township of Dill in order to extend the use of a garden suite in accordance with Section 39.1(4) of the Planning Act for a temporary period of three (3) years, as outlined in the report entitled “278 Old Wanup Road, Wanup” from the General Manager of Growth and Infrastructure, presented at the Planning Committee meeting on May 29, 2023.

    YEAS: (4)Councillor Lapierre, Councillor Fortin, Councillor Cormier, and Councillor Landry-Altmann
    Absent (1)Bill Leduc
    CARRIED (4 to 0)

    As no public comment, written or oral, has been received, there was no effect on the Planning Committee's decision.


The Planning Committee was adjourned and the Public Hearing was opened to deal with the application:

Wendy Kaufman, Senior Planner, outlined the report.

The Planning department responded to questions from the Committee members.

The agent for the applicant provided comments and responded to questions from the Committee members.

The Public Hearing was closed and the Planning Committee resumed in order to discuss and vote on the application.

  • The following resolution was presented:

    THAT the City of Greater Sudbury approves the application by Rushil Patel, Jayant Patel & Hiralben Patel to amend Zoning By-law 2010-100Z by changing the zoning classification from “R1-5”, Low Density Residential One, to “R3(S)” Medium Density Residential Special, on lands described as PIN 73589-0423, Parcel 14728, Lot 19, Plan M-215, Lot 7, Concession 2, Township of McKim, as outlined in the report entitled “1258 Southview Drive, Sudbury”, from the General Manager of Growth and Infrastructure, presented at the Planning Committee meeting on May 29, 2023, subject to the following conditions:

    1. That the amending zoning by-law include the following site-specific provisions:
      1. That a maximum of five (5) parking spaces shall be permitted in the required front yard.
      2. Planting strips shall not be required adjacent to the low density residential zones to the north, west and south.

    Public comment was received and consider and had no effect on Planning Committee's decision as the application represents good planning.


Councillor Lapierre, as Chair of the Closed Session, reported that the Committee met in Closed Session to deal with an update with respect to two (2) Proposed or Pending Acquisition or Disposition of Land Matters, the first regarding Birch Lane, Garson, and the second regarding Roy Avenue, Sudbury and Agincourt Avenue, Sudbury.

One (1) direction was provided to staff; and

One (1) recommendation emanated from the meeting.

  • The following resolution was presented:

    THAT the City of Greater Sudbury authorize the sale of vacant land east of Birch Lane in Garson legally described as part of PIN 73495-0856(LT), part of Lot 5, Concession 2, Township of Garson, City of Greater Sudbury;

    AND THAT the appropriate by-law be prepared to authorize the sale and the execution of the documents required to complete the real estate transaction;

    AND THAT the net proceeds of the sale be credited to the Capital Financing Reserve Fund – General.

    CARRIED
